PREAMBLE:
De huidige algemene verkoopsvoorwaarden zijn van toepassing op elke bestelling van een opleiding die door de klant bij de opleidingsorganisatie wordt geplaatst via de website http://www.theatremoderne.com, www.regulationemotionnelle.eu en https://admin-c2kom.fr/emotionnelanglais/.
Bijgevolg houdt het feit dat de klant zijn inschrijving voor de gekozen opleiding valideert, de verplichting in om de prijs te betalen en impliceert dit de volledige en onvoorwaardelijke aanvaarding door de klant van onderhavige algemene verkoopsvoorwaarden, met uitsluiting van alle andere documenten die slechts een indicatieve waarde hebben.
De aanvaarding van de huidige algemene verkoopsvoorwaarden impliceert, vanaf de validatie van de inschrijving, de totstandkoming van een contract waaraan de opleidingsorganisatie en de klant wederzijds gebonden moeten zijn.
Artikel 1 – Doel
De hierna beschreven algemene verkoopsvoorwaarden preciseren de rechten en plichten van de onderneming Théâtre Moderne en haar klanten in het kader van de verkoop van opleidingen en online cursussen.
Elke dienst die door de vennootschap Théâtre Moderne wordt geleverd, impliceert de onvoorwaardelijke aanvaarding door de koper van deze algemene verkoopsvoorwaarden.
Artikel 2 – Aanbiedingsvorm van de producten
De kenmerken van de te koop aangeboden producten worden voorgesteld in de rubriek « Opleidingscatalogus of individuele begeleiding » van onze website.
De foto’s komen niet in het contractuele veld. De verantwoordelijkheid van de onderneming Théâtre Moderne kan niet worden ingeroepen indien er fouten worden ingevoerd. Alle teksten en foto’s die op de site van Théâtre Moderne worden voorgesteld, vallen onder het auteursrecht en de intellectuele eigendom en hun reproductie, zelfs gedeeltelijk, is strikt verboden.
Artikel 3 – Geldigheidsduur van verkoopaanbiedingen
Afstandsonderwijs is geldig voor een variabele periode vanaf de datum van inschrijving.
Artikel 4 – Productprijzen
De rubriek » Prijzen » op onze website vermeldt de prijzen in euro, alle taksen inbegrepen. Théâtre Moderne is niet BTW-plichtig.
Théâtre Moderne behoudt zich het recht voor om zijn prijzen op elk moment te wijzigen, maar de bestelde producten worden gefactureerd tegen de prijs die geldt op het moment van de registratie van de bestelling.
Artikel 5 – Orde
De vennootschap Théâtre Moderne bevestigt de bestelling per e-mail, deze informatie omvat alle elementen van de bestelling en het herroepingsrecht van de klant.
De door de onderneming Théâtre Moderne geregistreerde gegevens vormen het bewijs van de aard, de inhoud en de datum van de bestelling. Deze laatste worden door het bedrijf Théâtre Moderne gearchiveerd onder de voorwaarden en binnen de wettelijke termijnen, de klant kan toegang krijgen tot deze archivering door contact op te nemen met de dienst Klantrelaties.
Artikel 6 – Betalingsvoorwaarden
De betaling van bestellingen geschiedt per creditcard.
Artikel 7 – Herroepingsrecht
Overeenkomstig de bepalingen van artikel L. 221-18 van het Wetboek van Consumentenrecht beschikt de klant of in voorkomend geval zijn wettelijke vertegenwoordiger over een termijn van veertien dagen om zijn herroepingsrecht uit te oefenen, zonder dat hij zijn beslissing hoeft te motiveren of andere kosten hoeft te dragen dan die waarin de artikelen L. 221-23 tot L. 221-25 voorzien. De uitoefening van het herroepingsrecht kan geschieden door toezending van een ondubbelzinnige verklaring waarin de wens van de klant of in voorkomend geval van zijn wettelijke vertegenwoordiger om de overeenkomst te herroepen, tot uitdrukking wordt gebracht. In toepassing van de verordening nr. 1182/71/EEG van de Raad van 3 juni 1971 houdende vaststelling van de regels die van toepassing zijn op termijnen, data en aanvangs- en vervaltijden :
1° De dag waarop de overeenkomst wordt gesloten of de dag waarop de goederen in ontvangst worden genomen, wordt niet meegerekend in de termijn bedoeld in artikel L. 221-18 ;
2° De termijn begint te lopen bij de aanvang van het eerste uur van de eerste dag en eindigt bij het einde van het laatste uur van de laatste dag van de termijn;
3° Indien deze termijn afloopt op een zaterdag, een zondag of een wettelijke feestdag, wordt hij verlengd tot de eerstvolgende werkdag.
Wanneer het herroepingsrecht wordt uitgeoefend, betaalt Théâtre Moderne de klant of, in voorkomend geval, diens wettelijke vertegenwoordiger, onverwijld en uiterlijk veertien dagen na de datum waarop hij in kennis is gesteld van de beslissing van de klant of, in voorkomend geval, diens wettelijke vertegenwoordiger om de overeenkomst te herroepen, alle betaalde sommen terug, inclusief de leveringskosten.
Théâtre Moderne zal de terugbetaling uitvoeren met hetzelfde betaalmiddel als datgene dat door de klant of zijn wettelijke vertegenwoordiger voor de oorspronkelijke transactie werd gebruikt.
Artikel 8 – Betalingsachterstand (clausule van toepassing op professionals)
In geval van gehele of gedeeltelijke niet-betaling van de geleverde prestaties op de met de gebruiker overeengekomen vervaldagen, is de koper aan Théâtre Moderne een nalatigheidsinterest verschuldigd gelijk aan anderhalve maal de wettelijke interestvoet en de beëindiging van de toegang tot het online cursusplatform.
De wettelijke rentevoet is deze die geldt op de dag van de levering van de goederen.
Deze boete wordt berekend op het openstaande bedrag, exclusief belastingen, en loopt vanaf de vervaldag van de prijs zonder dat een voorafgaande ingebrekestelling is vereist.
Overeenkomstig de artikelen 441-6 c. com. en D. 441-5 c. com. brengt elke vertraging van de betaling van rechtswege, naast de boetes voor laattijdige betaling, voor de debiteur de verplichting met zich mee een forfaitaire schadevergoeding van 40€ voor invorderingskosten te betalen.
Een aanvullende vergoeding kan, mits gemotiveerd, worden gevorderd wanneer de gemaakte incassokosten hoger zijn dan het bedrag van de vaste vergoeding.
Artikel 9 – Aansprakelijkheid en verzekering
Théâtre Moderne is gebonden door een middelenverbintenis. In geen enkel geval kan Théâtre Moderne aansprakelijk worden gesteld voor een geheel of gedeeltelijk defect van de Internetverbinding dat hem niet zou kunnen worden toegerekend of voor de niet-controle of de pannes van het informaticamaterieel van de klant. Théâtre Moderne onderschrijft en onderhoudt een geldige beroepsverzekering.
Artikel 10 – Overmacht
Théâtre Moderne kan niet aansprakelijk worden gesteld voor een schending van één van zijn verplichtingen uit hoofde van de onderhavige verkoopsvoorwaarden die het gevolg is van het optreden van een geval van overmacht in de zin van artikel 1148 van het Burgerlijk Wetboek, zoals dat in de Franse rechtspraak gebruikelijk is.
Artikel 11 – Klantenrelaties – Service na verkoop
Voor alle inlichtingen, vragen of klachten kan de klant van maandag tot vrijdag, van 9 tot 17 uur contact opnemen met de afdeling Klantrelaties.

Consequently, the fact that the customer validates his registration to the selected training course implies the obligation to pay the price and implies the full and unconditional acceptance of the customer to these general conditions of sale to the exclusion of all other documents which have only an indicative value.
The acceptance of the present general conditions of sale implies, from the moment of the validation of the registration, the formation of a contract to which the training organization and the customer must be mutually bound.
Article 1 – Purpose
The general terms and conditions of sale described hereafter detail the rights and obligations of the company Théâtre Moderne and its customers within the framework of the sale of training courses and online courses.
Any service provided by the Théâtre Moderne company implies the buyer’s unconditional acceptance of these general terms of sale.
Article 2 – Presentation of the products
The characteristics of the products offered for sale are presented in the section « Training catalog or individual support » of our website.
The photographs do not enter the contractual field. The responsibility of the company Théâtre Moderne cannot be engaged if errors are introduced there. All the texts and images presented on the site of the company Théâtre Moderne are reserved, for the whole world, under the copyright and intellectual property, their reproduction, even partial, is strictly prohibited.
Article 3 – Validity period of sales offers
Distance learning is valid for a variable period of time from the date of registration.
Article 4 – Product prices
The » Prices » sections of our website indicate the prices in euros, all taxes included. Théâtre Moderne is not subject to VAT.
Théâtre Moderne reserves the right to modify its prices at any time, but the products ordered will be invoiced at the price in effect at the time the order is registered.
Article 5 – Order
The company Théâtre Moderne confirms the order by e-mail, this information includes all the elements of the order and the right of withdrawal of the customer.
The data recorded by the company Théâtre Moderne constitute proof of the nature, content and date of the order. The latter is archived by the company Théâtre Moderne under the conditions and within the legal deadlines, the customer can access this archiving by contacting the Customer Relations department.
Article 6 – Terms of payment
The payment of orders is made by credit card.
Article 7 – Right of withdrawal
In accordance with the provisions of Article L. 221-18 of the Consumer Code, the customer or his legal representative, if applicable, has a period of fourteen days to exercise his right of withdrawal without having to give reasons for his decision or to bear other costs than those provided for in Articles L. 221-23 to L. 221-25. The exercise of the right of withdrawal can be made by sending a statement, unambiguous, expressing the desire of the customer or where appropriate his legal representative, to withdraw. In application of the regulation n°1182/71/ EEC of the Council of June 3, 1971 determining the rules applicable to periods, dates and terms :
1° The day on which the contract is concluded or the day on which the goods are received is not counted in the period mentioned in Article L. 221-18 ;
2° The time limit begins to run at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the time limit;
3° If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day.
When the right of withdrawal is exercised, Théâtre Moderne will reimburse the client or, if applicable, the client’s legal representative, for all sums paid, including delivery charges, without undue delay and no later than fourteen days from the date on which it is informed of the client’s or, if applicable, the client’s legal representative’s decision to withdraw.
Théâtre Moderne will make the refund using the same means of payment as the one used by the client or his legal representative for the initial transaction.
Article 8 – Late payment (clause applicable to professionals)
In the event of total or partial non-payment of the services provided on the due dates agreed with the user, the buyer must pay Théâtre Moderne a late payment penalty equal to one and a half times the legal interest rate and the termination of access to the online course platform.
The legal interest rate is the one in force on the day of the delivery of the goods.
This penalty is calculated on the amount of the outstanding amount, excluding taxes, and runs from the due date of the price without any prior notice of default being required.
In accordance with articles 441-6 c. com. and D. 441-5 c. com., any delay in payment automatically entails, in addition to the late payment penalties, an obligation for the debtor to pay a fixed indemnity of 40€ for collection costs.
An additional indemnity may be claimed, upon justification, when the collection costs incurred are higher than the amount of the fixed indemnity.
Article 9 – Liability and insurance
Théâtre Moderne is bound by an obligation of means. In no case Théâtre Moderne can be held responsible for a total or partial defect of Internet connection which would not be imputable to him or for the non-control or the breakdowns of the computer equipment of the customer. Théâtre Moderne subscribes and maintains a valid professional insurance.
Article 10 – Force majeure
Théâtre Moderne cannot be held responsible for a breach of any of its obligations under these terms and conditions of sale resulting from the occurrence of a case of force majeure within the meaning of Article 1148 of the Civil Code, as usually retained by French jurisprudence.
Article 11 – Customer relations – After-sales service
For any information, question or claim, the customer can contact from Monday to Friday, from 9 am to 5 pm to the Customer Relations Department.
